In 2002 former California Assembly member Tom Bates ran against incumbent Berkeley Mayor Shirley Dean, winning with 55% of the vote. Bates personally threw away approximately 1,000 copies of The Daily Californian, which had endorsed Dean. Bates pleaded guilty to petty theft and paid The Daily Californian $500 in restitution. According to a Daily Cal article, Bates “promised to speak to Berkeley schoolchildren about the consequences of their actions and … press for legislation making theft of free newspapers a crime.” The City of Berkeley passed this ordinance in 2003.
